For emergency work, except in limited circumstances, the straight-time of an applicant’s budgeted employees performing emergency work is not eligible. For unbudgeted employees performing emergency work, both straight-time and overtime labor are eligible. The Applicant has not demonstrated its FAL straight time and fringe benefit costs for emergency work were associated with unbudgeted screener employees. Accordingly, the FAL straight-time and fringe benefits’ costs for the scanner positions are not eligible for PA funding.

The Applicant has not demonstrated its FAL straight time and fringe benefits’ costs for emergency work were associated with eligible unbudgeted screener employees. Therefore, the appeal is denied.
