FEMA determines the eligibility of overtime costs based on the Applicant’s predisaster written labor policy, provided the policy meets certain requirements. On second appeal, the Applicant provided a predisaster pay policy that was in effect for three years before the disaster. Project management activities, such as construction oversight, are eligible provided that the activities are tracked and directly related to a specific eligible project work. On second appeal, the Applicant provided detailed reports, logs, and timecards documenting that the claimed straight-time and overtime FAL, as well as FAE costs, were tracked and directly tied to construction oversight of the Facility’s repair.
The Applicant has provided documentation that demonstrates the FAL and FAE costs are project management activities eligible for PA funding. Therefore, this appeal is granted in the amount of $39,384.05.
