Eligible emergency work includes emergency protective measures that are necessary to save lives and protect public health and safety. This may include the provision of emergency medical care when required as a direct result of the disaster. FEMA considers the urgency with which the applicant proceeds with work when evaluating the eligibility of emergency work. The equipment requested has not been purchased and is not associated with any eligible work related to the emergency treatment of patients with confirmed or suspected cases of COVID-19, or any other eligible work under FEMA’s COVID-19 policies. Further, the Applicant has continued functioning throughout the COVID-19 pandemic without using the requested equipment. FEMA finds that the future acquisition of EMS equipment for work that has not yet started, nearly three years into the pandemic, is not eligible.

CONCLUSION

FEMA finds that the Applicant did not demonstrate that the requested equipment is related to an eligible emergency protective measure in response to COVID-19. Therefore, this appeal is denied.
