For emergency protective measures to be eligible, the applicant is responsible for showing the work is required due to an immediate threat to lives, public health, or safety resulting from the declared incident. Under the COVID-19 Emergency Declaration, FEMA may provide assistance for certain emergency protective measures. The Applicant has not demonstrated how the claimed work and associated costs to continue providing worship services were eligible emergency protective measures undertaken in response to COVID-19.
The Applicant has not demonstrated that the work and associated costs to continue providing worship services were emergency protective measures required due to an immediate threat to lives, public health, or safety resulting from the declared incident. Therefore, this appeal is denied.
