The measures must be consistent with guidance applicable at the time from public health officials or the CDC. The Applicant has not demonstrated that the purchase of the air purifiers was done in accordance with guidance from the CDC or an appropriate public health official at the time the work was completed.
The Applicant has not demonstrated that the purchase of air purifiers is an eligible emergency protective measure in response to COVID-19. Therefore, this appeal is denied.
