For emergency protective measures to be eligible, the applicant is responsible for showing the work is required due to an immediate threat resulting from the declared incident. Here the Applicant has not demonstrated that the measures adopted either eliminated or lessened an immediate threat or are otherwise eligible for PA funding.

CONCLUSION

The Applicant has not demonstrated the work related to implementing social distancing and telework measures was required due to an immediate threat resulting from the declared incident or otherwise eligible for PA funding. Therefore, this appeal is denied.
