HEADNOTES

For emergency protective measures to be eligible, the applicant is responsible for showing the work is required due to an immediate threat and that the costs are necessary and reasonable to respond to the COVID-19 pandemic.

CONCLUSION

FEMA finds that the Applicant has not demonstrated that the work was an eligible emergency protective measure to safely open and operate a facility. FEMA also finds that the Applicant did not show its costs were reasonable and necessary. Therefore, this appeal is denied.
