Portable HEPA air purifiers are eligible when the applicant implements a layered approach to COVID. UVGI is eligible when it is installed based on certain criteria. The purchase of HEPA air purifiers equipment is eligible because the Applicant has demonstrated it implemented a layered approach, including mask wearing, social distancing, enhanced cleaning, and vaccines. However, the Applicant did not establish that the use of UVGI units were limited to installation in high-risk areas or where current HVAC is insufficient and therefore, the purchase of UVGI units is ineligible. Therefore, the appeal is partially granted in the amount of $14,335.25.

CONCLUSION

The Applicant has demonstrated the purchase of portable HEPA air purifiers is an eligible emergency protective measure. However, the UVGI units are ineligible because the Applicant did not establish that the Applicant installed the UVGI units in specific locations based on CDC recommendations. Therefore, the appeal is partially granted in the amount of $14,335.25.
