In response to COVID-19, FEMA may provide assistance only for the emergency protective measures listed in its COVID-19 policies. The provision of portable toilets is not included among the eligible emergency protective measures listed in FEMA’s COVID-19 policies. Handwashing stations may only be an eligible emergency protective measure when tied to the safe opening and operation of an eligible facility. Here, the Applicant did not establish the hand washing stations for the purpose of opening and operating its City Hall or public parks; rather, the hand washing stations were provided for the homeless population living in or near these areas.

CONCLUSION

Costs for portable hand washing stations and toilets are not tied to an eligible emergency protective measure under FEMA’s COVID-19 policies and are not eligible for PA funding. Therefore, this appeal is denied.
