For emergency protective measures to be eligible, the applicant is responsible for showing the work is required due to an immediate threat resulting from the declared incident. To be eligible for reimbursement, costs must be directly tied to the performance of eligible work and be adequately documented. The Applicant demonstrated costs for the lease of the Motel 6 were eligible for PA funding and this portion of the appeal is granted for $416,000.00. The Applicant has not demonstrated that $225,852.48 in costs for contract labor at the Econolodge NCS facility were tied to eligible emergency protective measures, and its appeal for those costs is denied.

CONCLUSION

The Applicant has demonstrated that the costs for the lease of the Motel 6 were eligible for PA funding and this portion of the appeal is granted for $416,000.00. The Applicant has not demonstrated that $225,852.48 in costs for contract labor at the Econolodge NCS facility were tied to eligible emergency protective measures, and its appeal for those costs is denied. FEMA has not made a previous finding on the costs related to electrical and security costs under GMP 145760, therefore, the Applicant’s appeal related to security services and electrical services is not ripe for decision at this time.
