HEADNOTES

To be eligible for PA funding, applicants are responsible for showing that emergency work is required due to an immediate threat resulting from the declared incident. The supporting documentation does not show where the debris was located or how it posed an immediate threat to lives, public health and safety, or a threat of significant damage to improved property. Additionally, the Applicant’s facilities, including its roads, are generally limited to the use of its residents and have policies restricting non-residents. Given the above, the claimed debris removal work was not in the public interest, as the Applicant has not demonstrated an immediate threat resulting from the disaster.

CONCLUSION

The claimed debris removal work was not required to eliminate an immediate threat caused by the disaster. Therefore, this appeal is denied.
