FEMA may fund removal of eligible vegetative debris including tree limbs, branches, stumps, or trees that are still in place, but damaged to the extent they pose an immediate threat. The Applicant submitted dozens of post-disaster photographs of the debris and its debris removal activities. However, the post-disaster photographs do not depict broken branches overhanging public roads or other rights-of-way, and thus do not demonstrate an immediate threat from hanging debris.
The Applicant has not demonstrated the claimed debris removal work was required to eliminate an immediate threat caused by the disaster. Therefore, this appeal is denied.
