Pursuant to FEMA policy, FEMA will not cover maintenance, utilities, or operational costs associated with the provision of temporary facilities, nor will it provide funding to cover the difference if those costs should increase because of the disaster. The costs of providing food, water, utilities, guarding prisoners, lodging for guards, and associated administrative work were costs related to operating the prison, not an emergency protective measure. Although the prison took in approximately 700 more prisoners, and the costs to operate the prison increased, these are ineligible increased operating expenses.
The costs of providing food, water, utilities, guarding prisoners, lodging for guards, and associated administrative work are ineligible increased operating costs. Accordingly, FEMA is denying the appeal.
