HEADNOTES

An eligible PNP facility is one that provides an eligible critical service (e.g., educational, utility, emergency, or medical) or provides a noncritical, but essential social service, and provides those services to the general public. PNP eligible critical services include education, such as primary or secondary education as determined under state law and provided in a day or residential school, including parochial schools. Administrative and support facilities essential to the provision of the PNP critical service are eligible. The Applicant has demonstrated the Staff Housing Buildings are support facilities essential to the provision of a PNP critical educational service. No applicant may receive assistance for a facility for which the applicant has previously received assistance unless all required insurance has been obtained and maintained with respect to the facility. The Applicant did not demonstrate it obtained the required insurance related to a previous disaster sub-grant condition.

CONCLUSION

FEMA finds that the Staff Housing Buildings are eligible facilities because they are support facilities essential to the provision of a PNP critical educational service. However, the Applicant did not demonstrate it obtained the required insurance from a previous disaster. Therefore, this appeal is denied.
