Removal of debris from public ROWs may be eligible. If local governments authorize residents to place incident-related debris on public ROWs, FEMA provides funding to remove the debris from the ROWs for a limited period of time. The Applicant substantiates that it authorized its residents to place debris from the disaster on public ROWs and the Applicant removed that debris from public ROWs. An applicant may use the value of donated resources to offset the non-Federal share of its eligible emergency work projects, provided the applicant tracks the resources and work performed and the applicant uses the donated resources for eligible emergency work. The Applicant has not substantiated that the claimed donated resources are limited to the performance of eligible emergency work on public ROWs and does not track the work in a way that enables FEMA to distinguish potentially eligible work from ineligible work.

CONCLUSION

The debris pick-up sites in GMP 150503 are eligible for PA funding, subject to the requirements for private property debris removal from public ROWs. However, the claimed donated resources in GMP 150694 are ineligible for PA funding because the Applicant has not demonstrated the claimed donated resources were used only for eligible emergency work. Therefore, the appeal for GMP 150503 is granted in the amount of $174,400.36 and the appeal for GMP 150694 is denied.
