Work must be required as a result of the disaster, and the applicant must demonstrate that the damage was directly caused by the declared incident. The submitted documentation shows the predisaster condition of the Facility’s abutments was a significant contributing factor in rendering the Facility non-functional after the disaster. The Applicant has not demonstrated the claimed damages are the direct result of the declared incident, rather than deferred maintenance, deterioration, or the Applicant’s failure to take measures to protect the Facility from further damage.
The Applicant has not demonstrated the claimed damage was directly caused by the declared incident. Therefore, this appeal is denied.
