This is in response to a letter from your office dated December 3, 2013, which transmitted the referenced second appeal on behalf of the City of Galveston (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of $393,961.70 in funding for the repair of a geotextile tube (Facility) at Beachside Village Beach. As explained in the enclosed analysis, the Regional Administrator correctly determined that the Applicant did not have legal responsibility for the Facility. As such, the Applicant is not eligible for Public Assistance funding for the repair of the Facility. Therefore, I am denying this appeal. Please inform the Applicant of my decision. This determination constitutes the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
