Insurance Reduction - Nashville-Davidson County

This is in response to a letter from your office dated September 18, 2012, which transmitted the referenced second appeal on behalf of the Metropolitan Government of Nashville-Davidson County (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency (FEMA) reduction of anticipated insurance proceeds from the amounts awarded under two Project Worksheets addressing damage to golf courses caused by flooding in 2010. As explained in the enclosed analysis, the Applicant’s insurance policy does not provide coverage for the damage under the two PWs and, therefore, the reductions in the PWs for anticipated insurance proceeds should be reinstated. The Applicant’s request for $13,090.75 for additional repair work under PW 4706 is eligible work, not covered under its insurance policy. Consequently, the Regional Administrator is instructed to review the Applicant’s supporting documentation and award eligible costs based on such. Please inform the Applicant of my decision. This determination constitutes the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
