This is in response to a letter from your office dated June 20, 2016, which transmitted the referenced second appeal on behalf of the Township of Rapidan (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of $354,043.22 to relocate the 563rd Lane roadway (Facility) following a 2010 storm event. As explained in the enclosed analysis, I have determined that the Applicant relocated its Facility, such that it encroached on an archaeologically sensitive site, and installed a retaining wall at the toe of the site without prior approval from FEMA. The Applicant completed construction without affording FEMA the opportunity to conduct the necessary environmental and historic preservation reviews and consultations required by National Historic Preservation Act § 106. As the Applicant did not comply with federal regulations and the terms of the grant award, the project is ineligible and deobligation of PW 1485 is appropiate. Therefore, I am denying the appeal. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
