This is in response to a letter from your office dated August 5, 2016, which transmitted the referenced second appeal on behalf of Milwaukee Immediate Care Center (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of $107,129.12 in funding for the repair and restoration of the Applicant’s facility. As explained in the enclosed analysis, I have determined that the Applicant’s first appeal was untimely and accordingly its appeal rights lapsed. In addition, the Applicant used federal funds for unauthorized purposes and materially failed to comply with the conditions of the award. Accordingly, I am denying this appeal. Please inform the Applicant of my decision. This determination is the final Agency decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
