This is in response to a letter from your office dated February 25, 2016, which transmitted the above referenced second appeal on behalf of the Township of Vernon (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of $268,898.21 in costs associated with permanent work performed on property owned by eight qualified private communities within the Applicant’s jurisdiction. As explained in the enclosed analysis, I have determined that the Applicant’s second appeal was not submitted within the 60-day timeframe as required by § 423(a) of The Stafford Act and by Title 44 Code of Federal Regulations (C.F.R.) § 206.206(c)(1). Accordingly, I am denying the appeal. Please inform the Applicant of my decision. This determination is the final Agency decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
