This is in response to a letter from your office dated May 16, 2016, which transmitted the referenced second appeal on behalf of the Private Nonprofit organization, A Very Special Place, Inc., (Applicant). The Applicant, which operates three sites, is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of funding in the amount of $74,762.73 for all repairs at one of its sites and $15,902.25 in repairs for the other two that were not part of the original scope of work in PW 2797. As explained in the enclosed analysis, I have determined that, pursuant to 44 C.F.R. § 206.206(c), the Applicant’s appeal is untimely. Accordingly, I am denying the appeal.
