This is in response to a letter from your office dated February 28, 2017, which transmitted the referenced second appeal on behalf of the University of Houston (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of $193,194.36 for a roof restoration. As explained in the enclosed analysis, restoration of the facility’s roof to its predisaster condition by replacement is appropriate given the nature and extent of damage. As the Applicant’s insurance policy only covered the cost of repair, the Applicant acted in a reasonably prudent manner in accepting a lower settlement amount reflecting only costs to repair the roof in order to maximize its overall insurance proceeds. Accordingly, I am granting this appeal. By copy of this letter, I am requesting the Regional Administrator to take appropriate action to implement this determination. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
