This is in response to a letter from your office dated May 24, 2017, which transmitted the referenced consolidated second appeal on behalf of the New York State Thruway Authority and Canal Corp. (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of reimbursement of $1,571,109.66, which represented insurance-related deductions. As explained in the enclosed analysis, I have determined that the Applicant’s second appeal was not submitted within the 60-day timeframe required by § 423(a) of the Stafford Act and by Title 44 Code of Federal Regulations (C.F.R.) § 206.206(c)(1).
