This is in response to a letter from your office dated November 15, 2017, which transmitted the referenced second appeal on behalf of the Metropolitan St. Louis Sewer District (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s denial of $5,207,756.61 for reimbursement of costs paid for damages to private property. As explained in the enclosed analysis, I have determined the Applicant has not demonstrated with supporting documentation that emergency protective measures were completed. Therefore, the Applicant’s costs related to reimbursing claims for sewer backup damage, are ineligible for Public Assistance funding. Accordingly, I am denying this appeal. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
