This is in response to a letter from your office dated June 27, 2017, which transmitted the referenced second appeal on behalf of Caddo-Bossier Parishes Port Commission (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s denial of $386,332.24 in costs pertaining to the repair of railcars owned by the Applicant’s tenants. As explained in the enclosed analysis, I have determined that the proposed work is ineligible for funding. The service agreements and lease agreement that were in place at the time of the disaster reflect the Applicant was not legally responsible for the repairs. In addition, neither the Louisiana Civil Code nor the Association of American Railroads Interchange Rules the Applicant cites places responsibility on the Applicant. Accordingly, I am denying this appeal. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
