This is in response to a letter from your office dated July 31, 2017, which transmitted the above referenced second appeals on behalf of the Roman Catholic Bishop of Springfield (Applicant). The Applicant is appealing the U.S. Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) decision to disallow direct administrative costs claimed for prorated travel expenses, its finding that the Applicant did not comply with Federal procurement requirements, and the enforcement action taken based on its finding of procurement noncompliance. As explained in the enclosed analysis, I have determined that the Applicant’s second appeals are untimely under Title 44 of the Code of Federal Regulations (44 C.F.R.) § 206.206(c)(2) because they were not forwarded within the required 60-day timeframe. Timeliness aside, the appeals would otherwise be denied because the Applicant did not demonstrate that: (1) its travel expenses are eligible for reimbursement as DAC; (2) it complied with Federal procurement standards in procuring Witt’s services; or (3) FEMA erred in reducing funding and awarding reasonable costs in each project as a remedy for the procurement noncompliance. Accordingly, I am denying the appeals. Please inform the Applicant of my decision. This determination is the final decision on these matters pursuant to 44 C.F.R. § 206.206, Appeals.
