This is in response to a letter from your office dated May 3, 2018, which transmitted the referenced second appeal on behalf of the Village of North Palm Beach (Applicant). The Applicant is appealing the U.S. Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) decision to uphold a partial deobligation of funding under PW 2682 (Version 4) based on an untimely appeal. As explained in the enclosed analysis, I have determined the Applicant’s first appeal was not submitted within the timeframe required by 44 C.F.R. § 206.206(c)(1), nor forwarded within the timeframe required by 44 C.F.R. § 206.206(c)(2). Accordingly, the appeal was untimely. Additionally, because the Applicant’s appeal rights lapsed, Stafford Act § 705(c) does not prevent FEMA from deobligating these funds. Accordingly, I am denying the appeal. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
