Net Small Project Overrun - City of Pensacola

This is in response to a letter from your office dated June 15, 2018, which transmitted the referenced second appeal on behalf of the City of Pensacola (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of $68,850.98 in cost overruns pertaining to lower than anticipated insurance proceeds. As explained in the enclosed analysis, I have determined that, because these are small projects, an appeal was not available to the Applicant to seek an adjustment of estimated insurance proceeds individually for PWs 75 and 85. For small projects, an appeal is available only if there is a significant net overrun related to all small projects for an applicant. Accordingly, I am dismissing this appeal. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
