This is in response to a letter from your office dated June 1, 2018, which transmitted the referenced second appeal on behalf of Tioga County (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s denial of its Request for Public Assistance (RPA) for damages related to Winter Storm Stella. As explained in the enclosed analysis, I have determined that neither the Applicant nor the Recipient have demonstrated that an extenuating circumstance, beyond either the Recipient’s or the Applicant’s control, would have excused the delayed RPA submission., as required by Title 44 Code of Federal Regulations (44 C.F.R.) 206.202(f)(2). Accordingly, I am denying this appeal. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
