This is in response to a letter from you dated September 11, 2018, which transmitted the referenced second appeal on behalf of the Nicholas County Board of Education (Subrecipient). The West Virginia Division of Homeland Security and Emergency Management (Recipient) is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s denial of costs associated with busing students and food to temporary school sites. As explained in the enclosed analysis, I have determined that the Recipient transmitted the first appeal to FEMA beyond the 60-day timeframe required by 44 C.F.R. § 206.206(c)(2).
