This is in response to a letter from your office dated August 24, 2018, which transmitted the referenced second appeal on behalf of the Iowa Department of Natural Resources (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s denial of $18,690.64 for a John Deere Gator (utility vehicle). As explained in the enclosed analysis, I have determined that the Iowa self-insurance plan includes a disaster contingency fund, which covers the utility vehicle for all hazards, thus satisfying the obtain and maintain requirement. This confirms the State Insurance Commissioner’s statement that any requirement to purchase additional flood insurance for the utility vehicle is not reasonable. Accordingly, I am granting this appeal. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
