This is in response to your letter dated June 27, 2018, which transmitted the referenced second appeal on behalf of the Roman Catholic Bishop of Springfield (Applicant). The Applicant is appealing the U.S. Department of Homeland Security’s Federal Emergency Management Agency’s denial of costs pertaining to security services, as well as a reduction in direct administrative costs (DAC) due to the Applicant’s noncompliance with procurement regulations and denial of travel expenses claimed as DAC. The Applicant requests $3,375,988.82 in funding. As explained in the enclosed analysis, I have determined that the costs for security services after construction of the chain link fence are ineligible, and only three security guards were necessary prior to construction of the fence. Moreover, these issues were identified by the Regional Administrator in a Request for Information, which notified the Applicant of the new eligibility issues and provided it with time to respond. In addition, FEMA properly reduced DAC due to the Applicant’s noncompliance with procurement regulations. Finally, the travel expenses claimed are not eligible DAC as they cannot be tied to this specific project. Accordingly, I am denying this appeal. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
