This is in response to a letter from your office dated May 11, 2016, which transmitted the referenced second appeal on behalf of Essex County (Applicant). The Applicant is appealing the U.S. Department of Homeland Security’s Federal Emergency Management Agency’s denial to amend the scope of work (SOW) in Project Worksheet (PW) 4059. As explained in the enclosed analysis, I have determined that the Applicant has demonstrated that the first proposal provided by its engineer restores the Applicant’s facility to its predisaster condition. Accordingly, I am granting this appeal, in part, and directing Region II to amend PW 4059 to include funding for the eligible work and to engage the Applicant to determine if the project is eligible for hazard mitigation or whether the Applicant would like to pursue an improved project. Please inform the Applicant of my decision. This determination is the final Agency decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
