This is in response to your letter dated January 24, 2017, which transmitted the referenced second appeal on behalf of Cuyahoga County Department of Public Works (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of funding in the amount of $388,359.00 to add a fire suppression system to comply with an Ohio Fire Code (OFC) at Whiskey Island Marina. As explained in the enclosed analysis, I have determined that, pursuant to 44 C.F.R. § 206.226(d) and Disaster Assistance Policy 9527.4, Construction Codes and Standards, because the OFC was uniformly applied and enforced, it does meet the criteria of codes and standards eligible for funding under the Public Assistance (PA) Program. As such, contingent upon the Applicant’s (1) demonstration within six months of the date of this decision that the enforcing authority directed it to comply with the fire suppression provisions (to include possible requirements associated with a variance), and (2) incurrence of actual costs to address the matter within one year of this decision, the fire suppression system is eligible for PA reimbursement. Accordingly, I am granting this appeal and directing the Region V Regional Administrator to take appropriate action. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
