This is in response to a letter from your office dated March 22, 2016, which transmitted the referenced second appeal on behalf of St. Mary’s Academy (Applicant). The Applicant provided additional documentation and requested the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) provide funding for additional items of work. As explained in the enclosed analysis, the Applicant failed to comply with procurement requirements and FEMA’s resulting enforcement action to address the noncompliance was appropriate. The issue of whether the Applicant submitted adequate documentation to substantiate eligible work and costs is not ripe for decision because the Regional Administrator, via the first appeal decision, afforded the Applicant with the opportunity to submit additional documentation for consideration at closeout. By copy of this letter, I am requesting the Regional Administrator to take appropriate action to implement this determination. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
