This is in response to a letter from your office dated September 8, 2016, which transmitted the referenced second appeal on behalf of the California Department of Developmental Services (Applicant). The Applicant is appealing the U.S. Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of $1,315,998.90 in Public Assistance funding for the restoration of a water diversion facility on Asbury Creek in Sonoma County, California. As explained in the enclosed analysis, I have determined that the Applicant provided documentation supporting the eligibility of work associated with the acquisition of an easement grant deed that was necessary for the project. However, the Applicant failed to demonstrate the eligibility of the remaining items of construction and professional services work on appeal. Accordingly, I am partially granting the appeal in the amount of $35,040.50. By copy of this letter, I am requesting the Regional Administrator take appropriate action to implement this determination. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
