This is in response to a letter from your office dated March 14, 2016, which transmitted the referenced second appeal on behalf of the Missouri Department of Natural Resources (Applicant). The Applicant is appealing the U.S. Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of $230,844.00 in Public Assistance funding to repair two lift stations. As explained in the enclosed analysis, I have determined that the Applicant has not demonstrated that additional damages are a direct result of the disaster and the Applicant exceeded the approved scope of work without notifying and obtaining the prior approval of FEMA or the Grantee. Furthermore, the Applicant’s failure to abide by the conditions of the grant prevented FEMA from performing an environmental and historic preservation review prior to construction commencing. Accordingly, I am denying the appeal. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
