This is in response to a letter from your office dated June 22, 2017, which transmitted the referenced second appeal on behalf of the Franklin County (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of $208,323.50 in costs pertaining to repair of roads and replacement of culverts. As explained in the enclosed analysis, I have determined that the final Request for Information issued prior to the first appeal decision did not sufficiently explain the basis for the denial of the appeal, and did not identify and request the documents that may have supported the appeal. Accordingly, I am remanding this appeal to Region VII so that a sufficient Request for Information can be issued and a new first appeal decision rendered. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
